These Terms and Conditions apply to the purchase and use of gift vouchers for personal training sessions provided by [Ultimate Performance Fitness]. By purchasing or redeeming a gift voucher, you agree to these terms, in addition to our general Personal Training Terms and Conditions, available here.
(Effective 2025 – applicable to all Ultimate Performance locations worldwide)
These Terms and Conditions (“Terms”) govern the purchase, redemption, and use of the Ultimate Performance “Gift of Health” promotional training packages (“Voucher” or “Promotion”). By purchasing or redeeming a Voucher, the purchaser (“Purchaser”) and the recipient (“Client”) acknowledge and agree to these Terms and any applicable Regional Annex.
1.1. The “Gift of Health” is a promotional discounted training offer providing either four (4) or eight (8) one-to-one personal-training sessions at a 30 % discount to the standard prevailing session rate applicable in the relevant region.
1.2. The Voucher represents a contractual right to receive specific personal-training services and does not represent stored monetary value, a “gift card”, “gift certificate”, prepaid card, or any similar payment instrument.
1.3. All sessions under the Voucher must be conducted in-gym with an Ultimate Performance (“U.P.”) trainer and are not valid for virtual sessions, online personal training, or OPT programmes.
1.4. Nothing in these Terms creates any right to a refund, resale, or cash redemption except as expressly provided herein or required by mandatory law.
1.5. Ultimate Performance ensures that all significant conditions relating to this Promotion, including eligibility, redemption deadlines, validity periods, usage restrictions, continuation rules, and pricing structure, are clearly disclosed in all promotional materials in accordance with the Digital Markets, Competition and Consumers Act 2024 and equivalent global consumer protection laws.
This Promotion may operate with different promotional periods for online and in-gym purchases. Each promotional period applies only to the channel through which the Voucher is purchased. Any amendment or withdrawal of a promotional period in one channel does not affect the promotional period or validity of Vouchers purchased via another channel.
1.7. Promotion Period Dates:
1.7.1 In-Gym Promotion Period: 21st November 2025 to 19th December 2025 (inclusive).Vouchers purchased in-gym are only available during this promotional period.
1.7.2 Online Promotion Period: 3rd December 2025 to 19th December 2025 (inclusive). Vouchers purchased online are only available during this promotional period.
1.8. These promotional periods relate solely to the availability of the Promotion for purchase via each channel. They do not affect the separate redemption or session-validity periods set out in these Terms
2.1. The Voucher is valid only for new clients (those who have never trained with U.P.) or returning/lapsed clients whose most recent training package expired at least six (6) months prior to purchase.
2.2. Existing clients with an active package may purchase a Voucher as a gift for another person but may not redeem it for themselves.
2.3. Each eligible individual may redeem one (1) Voucher only. Multiple vouchers per individual are not permitted, even if purchased through different channels.
3.1. Purchase Channels
· UK & US: Online via the official U.P. website or in any U.P. gym.
· All other regions (EU, Australia, Singapore, UAE): In-gym purchase only.
3.2. A Voucher is deemed purchased when full payment is received and confirmed by U.P.
3.3. Transfer Prior to Redemption:
· The Voucher may be gifted or transferred before redemption, provided the recipient satisfies the eligibility criteria.
· Once redeemed (as defined in Clause 4.5), the Voucher becomes personal to the named Client and non-transferable.
3.4. Vouchers may not be sold, auctioned, or exchanged for value without U.P.’s written consent.
4.1. Redemption Requirement:
· Redemption must occur within the applicable Regional Redemption Period stated in the Regional Annex.
· Redemption takes place when the Client completes the onboarding process and books their first training session in the U.P. scheduling system (MBO).
4.2. Session Validity:
· All sessions must be completed within sixty (60) days of the first booked session, unless a longer period is required by local law.
4.3. Location Restriction:
· Vouchers are redeemable only at the U.P. location stated on the Voucher.
· London-issued vouchers may be redeemed at any U.P. London gym.
4.4. Unredeemed or Unused Vouchers:
· Any Voucher not redeemed within its redemption period, or any session not used within its session-validity window, is forfeited without refund or credit unless required by applicable law.
4.5. Definition of Redemption:
· “Redemption” occurs on the earlier of (a) the Client’s first booking in MBO, or (b) completion of any part of the U.P. onboarding process (consultation, assessment, or training).
5.1. Upon redemption and commencement of training, the Client automatically becomes subject to the U.P. Standard Client Terms & Conditions applicable to the location of training, available at https://ultimateperformance.com/terms.
5.2. Those standard terms govern all training-related matters including scheduling, cancellation, conduct, safety, data use, and liability.
5.3. These promotional Terms govern only the purchase, redemption, and completion of the discounted sessions.
6.1. The Voucher may not be:
· Combined with any other discount, promotion, referral programme, or “1 + 1” offer, unless expressly authorised in writing;
· Exchanged for cash, credit, merchandise, or services other than personal-training sessions; or
· Split between multiple Clients after redemption.
6.2. Vouchers are subject to standard booking availability. U.P. does not guarantee specific trainer assignment or training time.
6.3. The Client must adhere to all U.P. gym policies and reasonable instructions for safety and conduct.
7.1. General Rule:
· Vouchers are non-refundable and hold no cash value.
7.2. Statutory Cooling-Off (UK/EU online sales):
· Purchasers have a fourteen (14)-day cancellation right under the Consumer Contracts Regulations 2013 / EU Directive 2011/83, provided no session has been redeemed.
7.3. Refund Amount:
· Where a refund is legally required, it will be limited strictly to the original purchase price paid for the Voucher, not the prevailing or future session rate.
7.4. Inability to Supply:
· If U.P. permanently closes the relevant location or cannot deliver the sessions, U.P. will offer a reasonable alternative or refund at the purchase price.
7.5. No Refund for Partial Use:
· No refund or credit will be given for partially completed packages, missed sessions, or expired vouchers.
8.1. Upon completion of all promotional sessions, Clients may continue training by entering into a new standard training agreement at the prevailing U.P. session rate for that location.
8.2. Continuation is optional and subject to a new purchase agreement.
9.1. U.P. maintains an electronic record of all Voucher sales, redemptions, and expiries through its scheduling and payment systems.
9.2. U.P. reserves the right to verify any Voucher’s authenticity and usage history before acceptance or refund.
9.3. Purchasers and Clients consent to U.P.’s internal processing of these records for accounting, compliance, and fraud-prevention purposes.
10.1. U.P. shall not be liable for any delay or failure to perform arising from causes beyond its reasonable control, including but not limited to natural disasters, pandemics, government restrictions, war, terrorism, strikes, or breakdown of communication networks.
10.2. In such circumstances, U.P. may suspend or extend the Voucher validity period for a reasonable time or offer a credit or reschedule at its discretion.
11.1. Personal information collected at purchase or redemption will be processed solely for:
· administration of the Voucher;
· onboarding, scheduling, and delivery of training sessions; and
· compliance with legal or regulatory requirements.
11.2. Processing complies with:
· UK GDPR & Data Protection Act 2018 (UK clients);
· EU GDPR 2016/679 (EU clients);
· PDPA 2012 (Singapore);
· DIFC Data Protection Law 2020 (UAE); and
· any equivalent local privacy regulation.

12.1. U.P.’s liability under this Promotion is limited to the value paid for the Voucher.
12.2. U.P. shall not be liable for:
· indirect or consequential loss;
· loss of enjoyment, opportunity, or anticipated savings;
· unavailability of preferred trainers or times; or
· expired or unredeemed Vouchers.
12.3. Nothing limits liability for death or personal injury caused by negligence or any other liability which cannot be excluded by law.
12.4. Participation in personal training carries inherent physical risks; Clients must complete the U.P. Health Questionnaire and disclose any medical conditions before commencing training.
12.5. Ultimate Performance reserves the right to remove this promotion at any time.
13.1. These Terms are governed by and construed in accordance with the law of the country in which the Voucher was purchased.
13.2. Local statutory consumer rights remain unaffected.
13.3. Any dispute shall be submitted exclusively to the courts of that jurisdiction.
