Personal Training Membership Terms & Conditions
Last Updated: 24th June 2025
These Terms & Conditions apply to all Personal Training Membership Packages purchased with UP Fitness, whether in-gym or virtual.
We offer recurring membership packages for in-gym or virtual personal training sessions (“Membership Packages”). Each package includes a fixed number of sessions to be used within a 60-day period, which begins when a personal trainer is assigned, and your first session is scheduled to commence. This period will be clearly communicated in your confirmation email to ensure you are aware of the start and end dates (the “Usage Period”).
Unless otherwise required by local consumer protection laws, any unused sessions will expire at the end of the Usage Period and will not be carried over or refunded.
Your Membership Package will automatically renew under the following conditions:
Your saved payment method will be charged accordingly.
For California residents, you will be required to affirmatively accept the automatic renewal terms at the time of sign-up, in accordance with the California Automatic Renewal Law. This consent is provided once when you initiate your Membership Package only.
Where required by law (e.g., the UK Consumer Contracts Regulations 2013, the California Automatic Renewal Law, or relevant EU directives), we will send a renewal reminder via email at least 7 days prior to renewal. For California residents, this reminder will:
Your billing will be triggered at the earlier of:
You may cancel your membership or request to change the number of sessions in your package at any time by emailing:
[email protected]
To avoid being charged for your next membership cycle, you must notify us at least 7 days before your expected renewal period.
If you cancel or change your membership after this point, your next cycle may already be in progress and billed. Don’t worry, you’ll still be able to use all sessions from that cycle, and your cancellation or change will take effect automatically at the end of the current Usage Period, or once all remaining sessions have been used, whichever comes first.
We recommend contacting us when you have at least four (4) sessions remaining in your current package to allow time for changes to take effect before your next billing cycle.
Refunds are typically processed within 3–7 business days. We aim to complete them as quickly as possible, and always within the legal maximum of 14 days.
A cancellation form is also available at your UP gym, but email is just as effective.
After cancellation, you may continue to use any remaining sessions until the earlier of:
UK Customers:
Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you are entitled to a 14-day cooling-off period for your initial Membership Package, starting from the date of purchase.
If you have not used any sessions, you may cancel within this period and receive a full refund.
Important: By booking or attending any session during the 14-day cooling-off period, you:
If you cancel after starting sessions during the cooling-off period, you may still be eligible for a partial refund, calculated proportionally based on the number of sessions used.
This cooling-off right applies only to your first Membership Package and does not apply to any subsequent renewals.
U.S. Customers:
Cooling-off periods vary by state. Where required (e.g., California: 3–5 days), we will honour your right to a full refund during the applicable period if no sessions have been used.
By booking or attending your first session after purchase, you agree that your membership begins immediately and that your refund rights may be limited in accordance with local law.
This cooling-off right applies only to your first Membership Package and does not apply to any subsequent renewals.
Other Regions:
Where required by law in jurisdictions such as Australia, Singapore, the UAE, DIFC, and the Netherlands, all mandatory cooling-off or withdrawal periods will be respected. These rights may vary based on the country of residence.
To avoid being charged for the next membership cycle, you must cancel your Membership Package at least 7 days prior to the renewal date.
Refunds for renewed Membership Packages will only be considered:
Any approved refunds will be documented and processed in line with consumer protection laws.
Non-Refundable Items
The following are not eligible for a refund unless required by law:
Legal Exceptions (e.g., for California Residents under Civil Code §1812.85)
Refunds may be required by law under certain conditions, including:
Refunds, when granted, will be processed within 3–7 business days, and always within the legal maximum of 14 days.
UP Fitness will not unreasonably withhold refunds where required under applicable consumer protection law
Memberships include a one-time onboarding fee, which is billed at the point of agreement (i.e., when you sign up). This fee is charged immediately and separately from your recurring membership billing, unless otherwise stated at sign up.
The onboarding fee covers the following services delivered before your regular personal training sessions begin:
The first session of your first Membership Package will be used to complete the final stage of your onboarding and will include a detailed review of your PARQ, goal finalizing, measurements and initial check in photographs.
Membership Billing and Start Date
Your recurring Membership Package will not be billed until your first training session is due to begin. This occurs when:
Refunds and Cooling-Off Period for the Onboarding Fee
The onboarding fee is non-refundable once either of the following occurs:
A refund of the onboarding fee may be granted at our discretion based on fairness and consistency if prior to the onboarding session and only within the cooling-off period. Any such discretionary refunds will be applied consistently and supported by documented reasoning to ensure fairness and compliance with applicable consumer protection laws.
In exceptional circumstances (e.g., medical issues or extended travel), you may request a temporary freeze or extension of your Usage Period.
Requests must be submitted in writing before the Usage Period ends. We may require evidence (e.g., a medical certificate).
All mandatory protections under UK, U.S., Singapore, Australian, UAE, DIFC, and Dutch consumer law will be upheld.
If you do not book or attend any sessions for 30 consecutive days, we will notify you via email before making any changes to your trainer assignment or schedule:
Resuming training after an extended gap is subject to trainer and schedule availability.
Note: These Terms apply subject to any mandatory consumer rights in your country of residence. Where local laws provide additional protections, those rights will take precedence.
