These Terms and Conditions apply to the purchase and use of gift vouchers for personal training sessions provided by [Ultimate Performance Fitness]. By purchasing or redeeming a gift voucher, you agree to these terms, in addition to our general Personal Training Terms and Conditions, available here.
1.1. “Gift Voucher” refers to the prepaid voucher issued for a specific number of personal training sessions.
1.2. “Purchaser” refers to the individual purchasing the gift voucher.
1.3. “Recipient” refers to the individual redeeming the gift voucher, which may be the Purchaser or another individual designated by the Purchaser.
1.4. “Current Pricing” refers to the pricing of personal training sessions used by Ultimate Performance Fitness at the location and time of redemption.
2.1. Gift vouchers are valid for 12 months from the date of purchase. The expiry date will be stated on the voucher.
2.2. The purchase of a gift voucher guarantees the session price at the time of purchase for 12 months.
2.3. If the gift voucher is redeemed after the 12-month validity period, the Recipient is liable to pay the difference between the original purchase price and the Current Pricing at the time of redemption.
2.4. Limited Availability – Gift vouchers are subject to limited stock and will be available on a first-come, first-served basis.
2.5. The promotion is valid only while stocks last, and U.P. Fitness Ltd reserves the right to withdraw the offer at any time without prior notice once the stock of gift vouchers is exhausted.
2.6. U.P. Fitness Ltd will not be held liable for any claims arising from the unavailability of gift vouchers due to limited stock.
3.1. To redeem a gift voucher, the Recipient must contact the Ultimate Performance Fitness Customer Experience team at [email protected]
3.2. Upon redemption, the Recipient will transition to the standard Ultimate Performance Fitness Personal Training Terms and Conditions.
3.3. Gift vouchers can only be redeemed for the specified number of personal training sessions stated on the voucher.
4.1. Gift vouchers are non-refundable and cannot be exchanged for cash or any other service or product unless required by local laws.
4.2. Gift vouchers are non-transferable unless explicitly agreed upon in writing by Ultimate Performance Fitness.
5.1. The company is not responsible for lost, stolen, or damaged gift vouchers.
5.2. In jurisdictions such as California, replacement vouchers may be issued upon proof of purchase, as required by law.
6.1. Redemption of sessions is subject to trainer availability and scheduling.
6.2. The company does not guarantee the availability of specific trainers. In the event of trainer changes, a qualified alternative will be provided.
7.1. Expired vouchers cannot be redeemed unless required by applicable consumer protection laws (e.g., California).
7.2. In cases where expired vouchers are redeemed as a gesture of goodwill, the Recipient will be required to pay any price differences based on Current Pricing.
8.1. In California, Maryland, and New York, refunds for unused balances or partial redemption will be issued if required by law.
8.2. In Australia, gift vouchers are valid for a minimum of three years unless otherwise specified.
8.3. In Singapore, UAE, and Hong Kong, AML regulations may require identity verification for high-value gift voucher transactions.
8.4. In the UK, Netherlands, and EU, a 14-day cooling-off period applies for online purchases, during which the Purchaser may cancel the gift voucher if it has not been redeemed.
9.1. The Recipient agrees to pay any additional charges incurred for session pricing adjustments if redeeming the voucher after the 12-month validity period.
9.2. Any additional charges must be paid in full before scheduling sessions.
10.1. The company reserves the right to amend these Terms and Conditions at any time, except where prohibited by local laws. Updated terms will be published on the company website and apply to vouchers issued thereafter.
10.2. These Terms and Conditions are governed by the laws of the jurisdiction in which the voucher was purchased. In the event of a conflict between these terms and local consumer protection laws, local laws will prevail.
